Privacy Policy
This Privacy Policy describes the information GownCard, Inc., a Delaware corporation ("GownCard," "we," "us"), may collect through the GownCard website, apps and related tools (the "Service"), and how we use, share, store and protect it.
This Policy applies to every user of the Service, including attending surgeons, nurses, scrub techs and other team members.
You acknowledge this Policy when you Accept the Terms of Use. You do not have to click a second time. This Policy will also stay available from a link on the Service. Capitalized terms not defined here have the meaning in the Terms.
1. What We Collect
Information You Give Us
We collect personal information about you as a user (sometimes called PII). That includes name, email address, password, professional role (for example surgeon or nurse), employer or facility you choose to name, any messages you send us and a record of your Acceptances (account, date, time, Terms version and Privacy Policy version). We also keep the content you create in the Service, including dictation, text, photos you upload and GownCard Procedure Cards. PII about you as a user is different from PHI, which is patient information. We collect PII to run your account. We do not want PHI.
Information Collected Automatically
When you use the Service we may collect log and device data such as IP address, browser type, pages viewed, dates and times, and cookie identifiers needed to keep you signed in and to understand how the Service is used. We may use basic analytics tools for the same purpose. If you allow it, we may also collect approximate or precise location so we can show nearby facilities or relevant GownCard Procedure Cards. You can refuse or later turn location off in your settings. Features that use location will not work if you do.
What We Do Not Seek
- Protected health information (PHI), meaning patient information. The Service is not designed to receive it. Do not enter it. If something incidental arrives, we treat that as a known case and may delete it. If you later notice PHI in the Service, you will delete it and tell us at notice@gowncard.com.
- Payment card or bank account numbers, unless you buy something from us.
- Advertising identifiers for targeted ads. We do not run targeted advertising.
2. How We Use Information
We use the information above to operate and secure the Service, create and maintain your account, organize content you submit into GownCard Procedure Cards, keep a record of which Terms and Privacy Policy versions you Accepted, communicate with you about the Service (including a new version you must Accept), diagnose problems and improve the Service. Service providers who host, store, send email, provide analytics or help organize content you submit do that work for us, under our instruction. We do not use that work to train a public model on your identifiable information. We may combine information from more than one source for those same purposes.
We may use and share de-identified or aggregated information that does not identify you, including for research, product improvement and commercial purposes.
3. How We Share Information
- Service providers who host, store, send email, provide analytics or help organize content you submit, only to do that work for us.
- Other users, only as the product allows (for example a card you have Approved, or a draft you choose to send to the attending of that card).
- Legal process, if required by law or to protect GownCard, our users or others.
- A real business change (for example a merger or sale), as part of that transaction.
We do not sell personal information that identifies you. If we assign the Terms or transfer the Service in a merger, sale, financing or other business change, this Policy applies to the successor and we may transfer your information as part of that transaction.
4. Retention
We keep account and card information while your account is open and for a reasonable time after, for backup, security and legal reasons. We keep Acceptance records (who, when and which version) even after an account closes. You may ask us to close your account by emailing notice@gowncard.com.
5. Your Choices
You can update account information in the Service or by emailing us. You can refuse cookies in your browser. Some features may not work if you do. You can stop promotional email (if we ever send it) with the unsubscribe link. We will still send service notices about your account.
6. Security
We use administrative, technical and physical safeguards we consider appropriate. No method of transmission or storage is completely secure. Please do not send sensitive information by ordinary email.
7. Children
The Service is for adults. It is not directed to children under 13, and we do not knowingly collect personal information from them. If you think we have, email notice@gowncard.com and we will delete it.
8. International
The Service is operated in the United States. If you access it from another country, you understand your information may be processed in the United States.
9. California
If you are a California resident and have a question about personal information we may have disclosed for direct marketing, email notice@gowncard.com with the subject line "California Privacy Request." We do not disclose personal information that identifies you for third-party direct marketing.
10. Updates
We may update this Policy by posting a new version in the Service. If we do, we will ask you to acknowledge the new version when you next sign in, as part of Accepting the current Terms. You must do that before you continue. If you do not, you may not use the Service. We may suspend or close the account, including by hand until the Service blocks access automatically.
